Halogen, it sure is lousy if the person that called and the affadavit indicated that the sweepstakes prize was $1,000,000. As someone stated above, the 1 million prize was an instant win ("moment in time") prize, and your gf would have known right away when she played. The fact that she was notified in late January indicates that she won the "sweepstakes prize", of which there was only one: $50,000. Here is the blurb from the rules concerning the prizes (I bolded the "sweepstakes prize" sentence):
(1056) PRIZES: Moment-In-Time Prizes: One (1) Grand Prize: $1,000,000.00 (awarded as a 40-year annuity at $25,000.00 per year without interest; present value of annuity: approximately USD$400,000.00)/Odds of Winning: 1:5,324,400; Four (4) First Prizes: $50,000.00 cash/Odds of Winning: 1:1,331,100; Fifty (50) Second Prizes: $500.00 cash/Odds of Winning: 1:106,488. Moment-In-Time prizes are only available for a randomly selected second in time throughout the Promotion Period, and will only be awarded in the event an entrant plays the game (meaning that the entry is received electronically by Sponsor) at the second for which the prize is randomly seeded. Because there may not be an entry for every second of the Promotion Period, all prizes may not be awarded. (1000) Instant Win Prizes: a $4.00 coupon towards any “Dream” beverage/frozen product. Instant Win prizes will also be seeded at randomly selected seconds throughout the Promotion Period. Instant Win prizes will be awarded to the person who plays the Game on or after the second at which the Instant Win prize is randomly seeded. The time of day when you play the game during the Promotion Period, as recorded by the Web site technology, will solely determine whether or not you are a potential winner. The number of Instant Win prizes available to be won will decrease as prizes are played for and/or claimed throughout the Promotion Period. The UPC is not used to determine winners; instead, Instant Win and Moment-In-Time prizes are randomly time seeded throughout the Promotion Period. (1) Sweepstakes Prize: $50,000.00 cash. The odds of winning the Sweepstakes Prize depend on the total number of eligible entries received.
Congrats to you and your gf, although it is such a disappointment after believing the prize was 1 million. If the affadavit did indeed state that she won the annuity prize (are you sure it didn't state that she won the sweepstakes prize, and you and she just assumed it was the 1 million since that seemed to be the top prize?), the sponsor would probably just fall back on their legal exemption clause in the rule stating they are not responsible for any errors that may have occured. In this case, the error would be "human" (I bolded the relevant statements).:
Sponsor and the Promotion Entities are not responsible for any problems that may arise, including but not limited to; (a) lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, Web sites, or other connection, availability or accessibility problems arising in connection with or over the course of the Game; or (b) communications failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions or hardware or software malfunctions, failures or difficulties; or (c) failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in these official rules, the offering or announcement of any prize or in any prize notification documents; or (d) for any errors of any kind in connection with the Game, whether human, mechanical, clerical, electronic, or technical in nature; or (e) the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Game; or (f) damage to a user's system occasioned by participation in this Game or downloading any information necessary to participate in this Game.
