3. CAR DRAWINGS/NOTIFICATIONS: There will be a total of three (3) random car drawings (hereinafter, Car Drawings). Three (3) semi-finalist winners will be selected in each Car Drawing for a total of nine (9) car semi-finalists, (hereinafter, Car Semi-Finalists). The random Car Drawings will be conducted by Centra Marketing & Communications, LLC, (hereinafter, the Judging Organization) an independent judging organization whose decisions on all matters relating to this Sweepstakes are final and binding in all respects pertaining to this Sweepstakes. Odds of winning depend on the number of Eligible Entries received. If the potential Car Semi-Finalists does not meet the eligibility or physical health requirements, is unavailable to participate in the Car Competition on the MARTHA SHOW on date designated by Sponsor and/or is ineligible at the time of the telephone call for any other reason, the potential Car Semi-Finalists will be disqualified and additional potential Car Semi-Finalists will be selected and contacted by telephone until the first three (3) Car Semi-Finalists from each Car Drawing meet all of the eligibility and physical health requirements and are available to participate in the Car Competition on the MARTHA SHOW on the dates designated by Sponsor. Potential Car Semi-Finalists who meet the pre-qualification criteria via phone will be sent an Affidavit of Eligibility and Liability and Publicity Release via e-mail and will be required to complete and return the Affidavit within twenty-four (24) hours of notification. Guests of the Car Semi-Finalists will also be required to complete and return a Travel Liability and Publicity Release within the same time period. 4. CAR SEMI-FINALIST PRIZES: There will be a total of nine (9) Car Semi-Finalist prizes. Each Car Semi-Finalist prize consists of round trip coach air transportation between major commercial airport nearest Car Semi-Finalist's residence and New York City, New York for Car Semi-Finalist and one (1) Guest, one (1) night hotel accommodations (double occupancy) at a hotel designated by Sponsor, round trip ground transfers between airport and hotel in New York City, round trip ground transfers between hotel and the MARTHA SHOW Studio and the chance to compete against two (2) other Car Semi-Finalists in the Car Competition on the MARTHA SHOW. The Approximate Retail Value (hereinafter, ARV) of each Car Semi-Finalist prize: $2,300. The Car Semi-Finalists selected in Car Drawing #1 will travel between September 17, 2006 and September 19, 2006. The Car Semi-Finalists selected in Car Drawing #2 will travel between September 27, 2006 and September 29, 2006. The Car Semi-Finalists selected in Car Drawing #3 will travel between October 8, 2006 and October 10, 2006.
THREE (3) CAR COMPETITIONS: There will be three (3) car competitions that will be featured on the MARTHA SHOW (hereinafter, the Car Competition(s)). The three (3) Car Semi-Finalists selected in Car Drawing #1 will participate in Car Competition #1 during the taping of the MARTHA SHOW on September 18, 2006. The three (3) Car Semi-Finalists selected in Car Drawing #2 will participate in car competition #2 during the taping of the MARTHA SHOW on September 28, 2006. The three (3) Car Semi-Finalists selected in Car Drawing #3 will participate in Car Competition #3 during the MARTHA SHOW taping on October 9, 2006 which will air on October 13, 2006. The instructions and details of each Car Competition will be provided to the participating Car Semi-Finalists one (1) hour prior to the start of each Car Competition.
6. THREE (3) CAR COMPETITION PRIZES: The winner of each Car Competition will be awarded one (1) model year 2007 Chevrolet Suburban vehicle with automatic transmission (hereinafter, the Car Competition Prize). The Manufacturer's Suggested Retail Price (hereinafter, MSRP) of each vehicle is: $51,000 each prize. Winners of the Car Competition Prizes (hereinafter, Car Competition Prize Winner(s)) will be solely responsible for all car title, license and registration fees, freight, delivery, dealer prep, emissions inspection, additional equipment, all federal, state and local taxes, insurance, gasoline, vehicle maintenance and all other fees and expenses associated with the receipt and use of the prize vehicles. The interior and exterior of the vehicle will be coordinated with each Car Competition Prize Winner. Additional costs associated with all additional car options will be the responsibility of the Car Competition Prize Winners. 7. GRAND PRIZE FINALIST DRAWINGS/NOTIFICATIONS: Three (3) Eligible Entrants will be randomly selected to participate in the Grand Prize Competition (as defined in paragraph 9 below) (hereinafter, Grand Prize Finalists). There will be two (2) Grand Prize Finalist drawings (hereinafter, the Grand Prize Finalists Drawings). The Grand Prize Finalist Drawings will be conducted from among Eligible Entries received as follows (all winning and non-winning entries from the three (3) Car Drawings will be combined and eligible for the Grand Prize Finalist Drawings): Grand Prize Finalist Drawing #1: For Eligible Entries received between 9:00 AM EDT on September 12, 2006 and 8:00 PM EDT on October 3, 2006. If the potential Grand Prize Finalist does not meet the eligibility or physical health requirements, cannot be available at the home where the potential Grand Prize Finalist received the telephone call from the Judging Organization, to receive a Grand Prize Finalist confirmation on either October 5, 2006, October 6, 2006, October 7, 2006 or October 8, 2006 as designated by Sponsor, is unavailable to participate in the Grand Prize Competition on the MARTHA SHOW on a date designated by Sponsor and/or is ineligible at the time of the telephone call for any other reason, the potential Grand Prize Finalist will be disqualified and additional potential Grand Prize Finalists will be selected and contacted by telephone until the first three (3) Grand Prize Finalists meet all of the eligibility and physical health requirements, are available at the homes where the Grand Prize Finalists received the telephone call from the Judging Organization to receive a Grand Prize Finalist confirmation on either October 5, 2006, October 6, 2006, October 7, 2006 or October 8, 2006 as designated by Sponsor and are available to participate in the Grand Prize Competition on the MARTHA SHOW on the date designated by Sponsor. Each Grand Prize Finalist prize consists of round trip coach air transportation between major commercial airport nearest Grand Prize Finalist's residence and Atlanta, Georgia for Grand Prize Finalist and one (1) Guest, two (2) nights hotel accommodations (double occupancy) at a hotel designated by Sponsor, round trip ground transfers between airport and hotel in Atlanta, Georgia, round trip ground transfers between hotel and the KB Home Community in the Atlanta, Georgia area, and the chance to compete against two (2) other Grand Prize Finalists in the Grand Prize Competition on the MARTHA SHOW. The ARV of each Grand Prize Finalist Prize: $3,000.
9. GRAND PRIZE COMPETITION: The Grand Prize competition will take place during a taping of the MARTHA SHOW in Atlanta, Georgia on October 16, 2006 (hereinafter, the Grand Prize Competition). The instructions and details of the Grand Prize Competition will be provided to the participating three (3) Grand Prize Finalists one (1) hour prior to the start of the Grand Prize Competition.
10. ONE (1) GRAND PRIZE: Grand Prize consists of one (1) KB Home valued at up to $400,000 in either the KB Martha Stewart community of Twin Lakes in Cary, North Carolina or Hampton Oaks in Atlanta, Georgia plus the standard KB Home Limited Warranty. The ARV of the Grand Prize is up to: $400,000. Grand Prize Winner will be solely responsible for all appliances fixtures, furniture, and decor. Grand Prize Winner will be solely responsible for all applicable title, recording, and escrow fees, expenses and taxes customarily related to the transfer of real property. In the event the Grand Prize Winner does not accept the KB Home valued at up to $400,000, the Grand Prize Winner will receive a check made payable to the Grand Prize Winner's order in the amount of $200,000 in lieu of the up to $400,000 KB Home.
ALL PRIZES: The total approximate retail value and MSRP of all prizes: $582,700. ARV of travel related prizes may vary based on airfare fluctuations and point of departure. Any difference in stated ARV and actual value of prize will not be awarded. Travel is subject to availability and blackout dates and restrictions will apply. Sponsor shall not be liable for any loss or damage to baggage. Prize Winners and Guests must travel on the same itinerary. Prize Winners and Guests will be solely responsible for obtaining valid identification relating to acceptance and use of the travel prize packages and the associated costs for these requirements. No substitution, cash redemption (except as stated in Paragraph 10), assignment, or transfer of any prize permitted, but Sponsor reserves the right to substitute a prize of equal or greater value in the event that an offered prize is unavailable for any reason. All Prize Winners must supply Sponsor with their social security numbers for tax purposes. All prizes will be awarded provided they are properly claimed.
11. INTERNET: If for any reason this Sweepstakes is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes, at which time, Sponsor will conduct a random drawing from among all Eligible Entries received at the time of the Sweepstakes termination.
